OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On 12/09/2011, at the Rock Creek Apartment Project in the Village of Rock Creek, Ohio: The bucket of the Caterpillar excavator was used as a personnel carrier for an employee who entered an 18 foot deep excavation to adjust the sump pump that was in the bottom of the excavation. Feasible abatement methods include, but are not limited to the following: a. Follow the Equipment Manufacturer's (Caterpillar) manual which states "Never use a bucket for a work platform or personnel carrier".
