29 CFR 1910.106(d)(4)(iv): Every inside storage room shall be provided with either a gravity or a mechanical exhaust ventilation system. Such system shall be designed to provide for a complete change of air within the room at least six times per hour. If a mechanical exhaust system is used, it shall be controlled by a switch located outside of the door. The ventilating equipment and any lighting fixtures shall be operated by the same switch. A pilot light shall be installed adjacent to the switch if Class I flammable liquids are dispensed within the room. Where gravity ventilation is provided, the fresh air intake, as well as the exhaust outlet from the room, shall be on the exterior of the building in which the room is located: The mechanical ventilation and the lighting were not operated by the same switch (interlocked) at the flammable storage room located on "the hill". The ventilation provided for 4 air changes per hour.

29 CFR 1910.106(e)(6)(ii): Class I liquids shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with: Class 1B flammables, including xylene and methyl ethyl ketone (MEK), were dispensed from primary 55-gallon drums into secondary containers without bonding or other means to electrically interconnect the two containers. The 55-gallon drums of flammables were not grounded.

29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: Employees entered stator frames to prep, paint, grind and weld the interior of the frames. There is a potentially hazardous atmosphere generated by the work done inside the frames. Note: Stator frames meet the definition of a confined space: (1) large enough for the employee to enter to perform work; (2) not designed for continuous employee occupancy; and, (3) have a limited or restricted means for entry and exit.

Cranes may be modified and rerated provided such modifications and the supporting structure are checked thoroughly for the new rated load by a qualified engineer or the equipment manufacturer. The crane shall be tested in accordance with paragraph (k) (2) of this section. New rated load shall be displayed in accordance with subparagraph (5) of this paragraph: Located on the "hill", written on the trolley of the MORTON 150 ton overhead crane was "25-TON-AUX"; however, the auxilliary hoist was marked 35 TON.
