29 CFR 1926.100(a):     Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:     On December 15, 2011 an employee was not protected by a hard hat while working below employees on a scaffold, exposing him to a struck-by hazard.    In accordance with CFR 29 1903.19(c) abatement certification is required of this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.451(c)(2):     Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:    On December 15, 2011 employee were exposed to the hazards associated with a scaffold collapse while working from a scaffold that was missing two baseplates.      In accordance with CFR 29 1903.19(c) abatement certification is required of this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     On or about December 15, 2011 employees were exposed to hazardous chemicals such as Portland cement and silica.  The company did not develop a hazard communications program which includes training, labeling and material data sheets.    In accordance with CFR 29 1903.19(c) abatement certification is required of this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
