Employees were exposed to potential impact injuries caused by falling materials and/or equipment. No additional abatement information is needed for this item.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. Ryan Monk, conducting work at 317 North Superior St., Toledo, OH: On or about October 11, 2011, the employer failed to ensure that employees were protected from fall hazards while working from the tubular welded frame scaffold on the Southwest side of the five story commercial building. Employees were repairing the Southwest wall of that commercial building. The scaffold was erected on the roof of the adjacent three story commercial building and employees were exposed to approximately a 30 foot fall hazard from the scaffold to the roof below. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

Ryan Monk, conducting work at 317 North Superior St., Toledo, OH: On or about October 11, 2011, the employer did not ensure that employees, working from the tubular welded frame scaffold on the Southwest side of the five story commercial building, were trained by a person, who is qualified in the subject matter, to recognize the hazards associated with the type of the scaffold being used and to understand the procedures to control or minimize those hazards. The scaffold was erected on the roof of the adjacent three story commercial building, and employees were exposed to approximately a 30 foot fall hazard from the scaffold to the roof below because they did not use any forms of fall protection while working from the scaffold. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Ryan Monk, conducting work at 317 North Superior St., Toledo, OH: On or about October 11, 2011, the employer failed to ensure that employees, working on the roof of the three story commercial building, were protected from fall hazards. One employee was required to work from the edge of the roof in order to bring components of the tubular welded frame scaffold to the roof, as well as lower those components to the ground below. Another employee was standing in a close proximity to the edge of the roof in order to observe vehicles that were parked in the alley below. Employees were exposed to approximately a 30 foot fall hazard from the roof to the ground below. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
