OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible wood dust deflagration, explosion, or other fire hazards while working at or near indoor dust collectors and associated ducting which were not designed to prevent or minimize employee exposure in the event of a deflagration or fire:    (a) Surface Enterprises, Inc. dba Kroma Antenna, located at 1465 W. Alexis Rd. Toledo, OH; on or about December 16, 2011, the indoor AireWorks media type dust collector lacked a means of (1) explosion protection and (2) fire protection.   	  (b) Surface Enterprises, Inc. dba Kroma Antenna, located at 1465 W. Alexis Rd. Toledo, OH; on or about December 16, 2011, the indoor two-stage Delta cyclone and enclosureless bag dust collector lacked a means of fire protection and was located within areas routinely occupied by employees.  In addition, the duct work upstream of the Delta dust collector was constructed of a non-metallic and non-conductive, PVC material.    Among other methods, a feasible method to correct this hazard would be to comply with National Fire Protection Association (NFPA) "Standard 664 (2007 ed.) Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities".   Specifically for instance (a) above, comply with Sections 8.2.2.5.1.4, 8.2.4, and Annex B.6. by either 1) locating the dust collector outside of buildings and providing a method of deflagration isolation to prevent the propagation of any deflagration back into the building or 2) equipping the dust collector with a method of explosion protection such as, but not limited to, a listed deflagration suppression system or a recognized safe method of deflagration venting AND by equipping the dust collector with automatic sprinkler fire protection.  For instance (b) above, comply with Sections 8.2.2.2.1.1, 8.2.2.2.1.2, 8.2.2.2.1.8, and 8.2.2.5.1.4 by providing metallic ductwork that is bonded and grounded, by equipping the dust collector with automatic sprinkler fire protection for the cyclone stage of the collector, AND by ensuring that the enclosureless bag stage of the collector is located 20 feet from means of egress and areas routinely occupied by employees.
