29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: "On or about December 15, 2011, Northern Grain Marketing, LLC employees was exposed to hazards including falls ranging from 6.4 feet (from the mid-point landing to boot pit) to 15.65 feet (from the upper access point to boot point), because the guard rail systems at those access points were not equipped with mid-rails and toe boards." There is no abatement certification or documentation required for this item.

On or about December 15, 2011, Northern Grain Marketing, LLC employees entered the east pit boot that was not designated as a permit required confined space. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit: Note: Appendix D to 29 CFR 1910.146 presents examples of permits whose elements are considered to comply with these requirements. On or about December 15, 2011, Northern Grain Marketing, LLC employees entered the east pit boot without the completion of an entry permit that would document measures had been taken such as, but not limited to, testing the atmosphere to verify that a safe entry could be made into the work area. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
