29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. (a) Bald Eagle Contracting, LLC on or about December 16, 2011, at the address of 435 Oldfield Rd. Crestline, OH: The employer failed to ensure an employee working from a JLG-3246ES scissor lift was adequately protected from falls. The employee was not tied off to the platform and was observed standing on atop the midrail, effectively bypassing all fall protection measures. The employee working from this condition was exposed to an approximate 40ft fall to the ground below.
