29 CFR 1926.800(k)(10)(i): Internal combustion engines, except diesel-powered engines on mobile equipment, are prohibited underground. (a) Inside the tunnel on or about December 8, 2011, and at times prior thereto, gasoline powered forklifts, scissors lifts, aerial lifts and pick-up trucks were operated. There was hot work in the tunnel, the fire suppression system installation was ongoing, and the mechanical ventilation was not operational.

29 CFR 1926.800(m)(5)(i): Gasoline shall not be carried, stored, or used underground: (a) Inside the tunnel on or about December 8, 2011, and at times prior thereto, gasoline powered forklifts, scissors lifts, aerial lifts and pick-up trucks were operated. There was hot work in the tunnel, the fire suppression system installation was ongoing, and the mechanical ventilation was not operational. Employees were exposed to the hazard of fire.
