(a) Inside the tunnel on or about December 8, 2011, and at times prior thereto, gasoline powered forklifts, scissors lifts, aerial lifts and pick-up trucks were operated. There was hot work in the tunnel, the fire suppression system installation was ongoing, and the mechanical ventilation was not operational.
