29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) Hohenbrink Excavating, LLC worksite located at the intersection of Fourth St. & Pratt St., Ottawa, Ohio: On or about December 19, 2011, the employer did not ensure employees were protected from cave-in hazards while installing a sanitary sewer manhole. The east and west ends of the manhole box were not protected exposing the employee to approximately 12.00 feet of near vertical "C" soil.

29 CFR 1926.251(a)(1): Defective rigging equipment was not removed from service: A. Hohenbrink Excavating, LLC worksite located at the intersection of Fourth St. & Pratt St., Ottawa, Ohio: On or about December 19, 2011, the employer did not ensure the hook attached to the excavator had an operable safety latch while hoisting a manhole trench shield into the trench preventing the rigging from leaving the throat of the hook. Hohenbrink Excavating, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.251, which was contained in OSHA inspection number 311610034, citation number 01, item number 01 and was affirmed as a final order on August 6, 2009, with respect to a workplace located at Leipsic, OH.
