29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section,each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrailsystem, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safetymonitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring systemalone [i.e. without the warning line system] is permitted. a) The implementation of the enforcement provisions of the safety program were not adequate to assure compliance with the applicable provisions of Part 29CFR1926.

29 CFR 1926.451(g)(4): Guardrail systems installed to meet the requirements of this section shall comply with the followingprovisions (guardrail systems built in accordance with Appendix A to this subpart will be deemed to meet the requirements of paragraphs (g)(4)(vii),(viii), and (ix) of this section): a) At the site, it was observed that the employees were working at a height at approximately 50 feet without the use of a mid-rail on a JLG Scissor lift for their barrier against falls. There was a chain on the JLG's basket to be used as a mid-rail but one end of the chain was disconnected from the basket's frame which no longer served as a mid-rail.

29 CFR 1926.453(b)(2)(iv): Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position. There were employees climbing in and out of a JLG aerial lift through the guard rail system in order to gain access onto a rooftop. The rooftop was approximately 50 feet above the next lower surface and no adequate fall protection was provided for the employees while accessing the roof.

29 CFR 1926.502(d)(21): Personal fall arrest systems shall be inspected prior to each use for wear, damage and other deterioration, and defective components shall be removed from service. a.) During the inspection it was found that the inspections were not adaquate of the personal fall arrest system. An employee's lanyard had significant wear and signs of deterioration on the snap hook. It was also observed that the identification tag was no longer legible on the lanyard.

29 CFR 1926.502(d)(23): Personal fall arrest systems shall not be attached to guardrail systems, nor shall they be attached to hoists except as specified in other subparts of this Part. a) During the inspection, it was found that there were employees attaching their lanyards to the toe board of the JLG aerial lift while working from the roof's edge at approximately 50 feet above the next lower surface.
