29 CFR 1926.451(g)(1)(vii):     For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4)of this section.        a)     At the jobsite, on the west side of the new build, the employer did not ensure that employees performing stucco prep work from a pump jack scaffold platform were protected from falling by use of a guardrail system or fall arrest system.  The employees were exposed to an approximate 13 foot fall hazard.    b)     At the jobsite, on the northeast end of the pump jack scaffold, the employer did not ensure that the employee performing stucco prep work were protected from falling by use of a guardrail system or fall arrest system.  The employee was exposed to an approximate 14 foot fall hazard.        Creative Stucco Corporation was previously cited for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.451(g)(4)(i), which was contained in OSHA Inspection Number 311837686 (50753-OIS no.), Citation Number 1, Item Number 2 and was affirmed as a final order on November 03, 2008, with respect to a workplace located at 6596 Sea Drive, Lewis Center, Oh 43035.

29 CFR 1926.454(c)(3):     When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer shall retrain each such employee so that the requisite proficiency is regained. Retraining is required in at least the following situations:  29 CFR 1926.454(c)(3):  Where inadequacies in an affected employee's work involving scaffolds indicate that the employee has not retained the requisite proficiency:      a)     At the jobsite, the employer did not ensure that employees working from the pump jack scaffold platforms had a clear understanding of the requirement for utilizing fall protection when required.          Creative Stucco Corporation was previously cited for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.454(c), contained in OSHA Inspection Number 311837686 (OIS no. 50753), Citation Number 1, Item Number 3 and was affirmed as a final order on November 03, 2008, with respect to a workplace located at 6596 Sea Drive, Lewis Center, Ohio 43035.
