Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm. Employees were exposed to the hazards associated with crushing and caught in between hazards. "The employer modified the 544J Front End Loader by adding an unapproved attachment voiding the manufacturer's approval andexposing employees to caught in and/or struck by hazards. AMONG OTHER METHODS, A FEASIBLE ABATEMENT METHOD TO CORRECT THIS HAZARD COULD BE ABATED BY ADHERENCE TO: John Deere 544 J Loader Serial no. 611800 Operators Manual OMT229869 "Avoid Unauthorized machine Modification" "Modifications of this machine, or addition of unapproved products or attachments, may affect machine stability or reliability, and may create a hazard for the operator or others near the machine." "Always contact an authorized John Deere dealer before making machine modifications that change the intended use, weight or balance of the machine, or that alter machine."
