29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Toledo Bag - Toledo, Ohio: On or about December 29, 2011, the employer failed to provide employees operating the Toyota forklift with adequate training to ensure safe operation of the vehicle. Employees were exposed to crushed-by and struck-by hazards while operating the forklift.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of this body in the danger zone during the operating cycle: a) Toledo Bag - Toledo, Ohio: On or about December 29, 2011, the employer failed to adequately guard the point of operation on the Marathon baler (Model No. V6030, Serial No. 46757). Employees were exposed to caught-in and crushing hazards while operating the machine.
