OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck by and crushing hazards: (b) Auto repair shop: On or about December 29, 2011 and at times prior thereto, employees were exposed to a struck by and crushing hazard while elevating vehicles on lifts such as but not limited to Gemini Lifts #1 and #2, with non-functioning swing arm stops, due to non-factory locks that allow the swing arms to deflect horizontally. (c) Auto repair shop: On or about December 29, 2011 and at times prior thereto, employees were exposed to a struck by and crushing hazard while elevating vehicles on lifts such as but not limited to Gemini Lifts #1 and #2, with arms that deflect laterally due to worn internal parts. (e) Auto repair shop: On or about December 29, 2011 and at times prior thereto, employees were exposed to a struck by and crushing hazard while elevating vehicles on lifts without annual inspections.

29 CFR 1910.26(c)(3)(vii): Ladders were being used as a brace, skid, guy or gin pole, gangway, or for other uses than that for which they were intended: On or about December 29, 2011 and at times prior thereto, employees were exposed to struck by hazards while in the area of a 20 foot extension ladder being used as a brace to hold the top cross member of a Gemini Auto Lift in place.
