29 CFR 1926.350(a)(10):     Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials(especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.    a. At the construction site located in Jackson, Ohio, where employees were using oxygen and acetylene in welding operations, oxygen cylinders were stored directly next to acetylene cylinders.

29 CFR 1926.501(b)(14):     "Wall openings." Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.    a. At the construction site located in Jackson, Ohio the employer had several wall openings along the stairwell that was used to access the working floors.  The wall openings were located approximately 3 stories up and 6 stories up along the staircase.  The opening at the third story had a top-rail, but no mid-rail.  The opening at the sixth story had neither a top-rail or mid-rail.

29 CFR 1926.1431(e)(6):     The personnel platform must be equipped with a guardrail system which meets the requirements of subpart M of this part, and must be enclosed at least from the toeboard to mid-rail with either solid construction material or expanded metal having openings no greater than  inch (1.27 cm). Points to which personal fall arrest systems are attached must meet the anchorage requirements in subpart M of this part.    a. At the construction site located in Jackson, Ohio the employer had a personnel platform that was at the site that did not have all four sides enclosed from the toeboard to the mid-rail.  The personnel platform had three sides enclosed on three sides from the toeboard to the top-rail with expanded metal, but the side of the platform that the entrance gate was located had no enclosure, only guardrails.

Platforms must not be used to hoist materials or tools when not hoisting personnel.    a. At the construction site located in Jackson, Ohio the employer had a personnel platform that was at the site that was, at times, used to hoist only materials up to the various working levels of the structure.
