29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: (a) Bulk tank ladder to Production roof: On 12/29/2011 and at times prior thereto, an intermediate ladder landing at 9 6 high was not protected to prevent a worker from walking directly into the opening. (b) Bulk tank ladder to Production roof: On 12/29/2011 and at times prior thereto, the ladder opening to the top of the tank at 16 high was not protected to prevent a worker from walking directly into the opening. 29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section on all open sides except where there is an entrance to a ramp, stairway, or fixed ladder: (a) Bulk tank ladder to Production roof: On 12/29/2011 and at times prior thereto, an intermediate ladder landing at 9 6 high was not protected to prevent a worker from walking directly into the opening. (b) Production: On 12/29/2011 and at times prior thereto, workers accessed a 9 3 high platform that was not protected by standard railing to service a vitamin E tote. Note: Toeboards are only required where tools, machine parts, or materials are likely to be used on the runway. Note: Abatement certification IS required for this item.

29 CFR 1910.305(e)(1): Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in damp or wet locations were not installed to prevent moisture or water from entering and accumulating within the enclosures and were not mounted so there is at least 6.35-mm (0.25-in) airspace between the enclosure and the wall or other supporting surface: (a) Load Out Pump 2: On 12/29/2011 and at times prior thereto, an electrical control box was subject to water invasion due to improperly connected conduit. (b) Load Out Pump 2: On 12/29/2011 and at times prior thereto, an electrical control box in a wet location (outdoors) was mounted directly to a concrete curb with inadequate airspace between the box and mounting surface. Note: Abatement certification IS required for this item.
