29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Superior Demolition, Inc., Mason Street Flats, 311 N. Mason, Fort Collins, CO: The employer did not ensure appropriate fall protection was installed on the east side of the second story deck prior to the start of work. On or about December 23, 2012, an estimated 20 foot wide section of open sided floor was without wire rope guardrails to prevent falls to the lower level. Condition exposed employees to a fall hazard of approximately 14 feet. Abatement Note: Abatement certification is not required for this item.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches plus or minus 3 inches above the walking/working level: a) Superior Demolition, Inc., Mason Street Flats, 311 N. Mason, Fort Collins, CO: The employer did not ensure the wire rope guardrails located on the north side of the second story deck were maintained at an appropriate height. On or about December 23, 2011, the top wire rope guardrail was measured at 31 inches above the floor level. Condition exposed employees to a fall hazard of approximately 14 feet. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter).

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): a) Brinkman Construction, Mason Street Flats, 311 N. Mason, Fort Collins, CO: On or about December 23, 2011, the controlling employer (contractor) in charge of the worksite did not ensure a competent person conducted an inspection of the fall protection system prior to the start of work. The wire rope guardrails located on the north side of the second story floor were damaged in addition to a missing 20 foot wide section of guardrail on the east side of the floor. Condition exposed employees working for a sub-contractor to a fall hazard of approximately 14 feet. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter).
