29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a. On or about July 28, 2011, at the above addressed jobsite, an employee was installing a sewer line in a trench measured at six (6) feet two (2) inches in depth. The trench was not provided with cave in protection, thereby exposing the employees to cave in hazards. THE EVERGREEN MECHANICAL CONTRACTORS, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311253629, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 14, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT SOUTHWEST CORNER OF ROUTE 53 and MAPLE AVENUE, LISLE, IL 60532.
