29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (l).    (a)  Metro One Building Services of Michigan, Inc. on or about January 06, 2012, at the address of 1150 Broad Ave. Findlay, OH: The employer did not ensure employees were formally trained in the operation of the Lull model 944E-42 extending boom forklift. An evaluation of competency for the employee operating the stated forklift was not conducted and documented by the employer. The employee operating and others working around the forklift were potentially exposed to struck-by injuries due to operation by an untrained operator.

29 CFR 1926.451(e)(1): Scaffold platforms more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used.     (a) Metro One Building Services of Michigan, Inc. on or about January 06, 2012, at the address of 1150 Broad Ave. Findlay, OH: The employer failed to ensure employees utilizing tubular welded frame scaffolding were prohibited from using cross braces as a means of access/egress. Employees were exposed to falls when using the cross braces to gain access to the working platform.
