29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. On or about January 5, 2012 - at the above addressed jobsite, an employee performing a pipe connection inside a trench measured at six (6) feet to seven (7) feet in depth. The trench was not proviede with an adequate protective system, thereby exposing the employee to the hazards associated with cave ins. THE CMG CONSTRUCTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.652(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313931362, CITATION NUMBER 01, ITEM NUMBER 002 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 16, 2009 WITH RESPECT TO A WORKPLACE LOCATED AT COUNTRYSIDE PLAZA ROAD & LAGRANGE, COUNTRYSIDE, IL 60525.
