29 CFR 1910.1028(e)(5)(i): The employer did not institute the exposure monitoring required under paragraphs (e)(2) and (e)(3) when there was a change in the production process, control equipment, personnel or work practices which could result in new or additional exposures to benzene, or when the employer had any reason to suspect a change which could have resulted in new or additional exposures: (a) GE Betz, Inc. Dba GE Water & Process Technologies, 5801 Brighton Blvd., Commerce City, CO: On and before 1/4/12, the employer did not institute the exposure monitoring required under paragraphs (e)(2) and (e)(3) when the employer had any reason to suspect a change which could have resulted in new or additional exposures. The employer was made aware of an underground source of benzene on the Suncor property which volatilized into the North Office Complex (NOC). The employer did not institute an air monitoring program to determine employee exposure to benzene. Low levels of airborne benzene were found in the NOC.
