29 CFR 1926.404(b)(1)(iii)(C): Where an assured equipment grounding conductor program was being utilized, equipment found to be damaged or defective was being used prior to being repaired: On January 11, 2012 employees were exposed to an electrical shock as they used cord set and corded equipment that was not checked for damage on a daily basis. In accordance with CFR 29 1903.19(c) abatement certification is required of this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) On January 11, 2012 an employee was not protected from a fall as he installed a fascia board to a residential soffit, exposing him to a fall hazard of 12.5 feet above grade. b) On January 11, 2012 employees were not protected from a fall as they framed/ worked in a residential property where the windows were not guarded, exposing them to a fall hazard of approximately 15 feet above grade. In accordance with CFR 29 1903.19(d) abatement documentation is required of this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
