29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites: (a) In section R 9 or the cosmetic section of the store on or about January 13, 2012, and at times prior thereto, there was no assured equipment grounding conductor program or ground-fault circuit-interrupter program when extension cords were used to charge the batteries on scissors lifts. The cords were powered from 110 VAC floor outlets in the store.
