29 CFR 1910.157(e)(2):     Portable extinguishers or hose used in lieu thereof under paragraph (d)(3) of this section shall be visually inspected monthly.    Engineered Plastic Components, Inc. had portable fire extinguishers within their facility for employee use in the event of a fire.  The company did not perform monthly visual inspections of the portable fire extinguishers to ensure that they were fully charged, undamaged, and ready for immediate employee use.

29 CFR 1910.157(g)(1):     Where the employer has provided portable fire extinguishers for employee use in the workplace, the employer shall also provide an educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting.    Engineered Plastic Components, Inc. had portable fire extinguishers within their facility for employee use in the event of a fire.  The company did not provide an educational program to employees, in order to familiarize employees with the general principles of fire extinguisher use and the hazards associated with incipient stage fire fighting.

29 CFR 1910.178(l)(1)(i):     The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    Engineered Plastic Components, Inc.  had employees operate powered industrial trucks on a daily basis without providing the employees with forklift training and evaluation.  This training would include:    a.	Formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material),  b.	Practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and   c.	Evaluation of the operators performance in the workplace.

29 CFR 1910.178(l)(6):     Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.    Engineered Plastic Components, Inc.  had employees operating powered industrial trucks, and the employer did not provide each forklift operator with a training and evaluation certification.   The certification would include the following:     a.	Name of the operator,   b.	Date of the training,   c.	Date of the evaluation, and   d.	Identity of the person(s) performing the training or evaluation.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    Engineered Plastic Components, Inc.  had employees operating powered industrial trucks daily and on multiple shifts at the facility, and the employer did not institute a forklift inspection program.  This inspection program would include:    a.	Daily forklift inspections and/or  b.	Shift forklift inspections for those used on a round-the-clock basis.
