Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the rough terrain forklift:    (a)  Throughout the entire job site:  On or about January 12, 2012, and at times prior thereto, the employer did not instruct and/or enforce the utilization of the seat belts by operator(s) of the Ingersol Rand Rough Terrain Forklift.    Note(1): Amongst other methods, several feasible and acceptable methods to correct this hazard is by complying with the manufacturer's operation guide regarding use of the manufacturer supplied seatbelt and/or QNWI/ITSDF B56.1-2005 (Reaffirmation of B56.1-2004), Section 7.41, Operator Restraint Systems.    Note(2): Abatement certification IS NOT required for this item.

29 CFR 1920.178(l)(1)(i): This provision is applicable to construction employment by 1926.602(d): The employer did not ensure that each powered industrial truck operator was competent to operator a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in 29 CFR 1910.178 paragraph (l):    (a)  On or about January 12, 2012, and at times prior thereto, the employer did not certify each operator had been trained and evaluated prior to the operation of a rough terrain forklift.
