29 CFR 1926.1053(b)(1):     Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    On or about January 18, 2012, and at times prior thereto, employees were exposed to a fall of approximately 20 feet to the ground below while using a ladder to access the roof with ladder slide rails extending approximately 1 foot above the landing surface.

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    On or about January 18, 2012, and at times prior thereto, employees were exposed to a fall of approximately 20 feet to the ground below while siding an upper area of the exterior wall from the roof without fall protection.    DARK HORSE CONTRACTING WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.501(b)(13,  WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314315110 CIITATION NUMBER 01, ITEM NUMBER 001a AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 29, 2010, WITH RESPECT TO A WORKPLACE LOCATED AT 1727 WEST COLLEGE, BOZEMAN, MONTANA, 59718.
