29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling: (a) On or about 18 January 2012, the employer did not ensure that a relocatable power strip (Phillips Model 1001133; Part SPS2207) was not plugged into the outlet of another flexible extension cord. The labeled use of the power strip indicates "Do not plug into another relocatable power tap. Use indoors and dry locations only". In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure: On or about 18 January 2012, the employer did not ensure that electrical cooking appliances were plugged into fixed wiring instead of flexible cords or cables. a) An electrical cooking pot was plugged into the relocatable power strip. In its turn, the power strip was plugged into another very long flexible extension cord which led all the way from the employees assigned work area into the rafters where it connected to a hard-wired power outlet. b) A microwave was plugged into a relocatable power strip which was plugged into hard-wired outlet. c) An electrical cooking pot was plugged into a relocatable power strip which was plugged into hard-wired outlet. d) An electric coffee pot was plugged into a relocatable power strip which was plugged into hard-wired outlet. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) ......, the employer did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following: 1) Requirement for labeling of containers of hazardous chemicals; 2) Material safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees. On or about 18 January 2012, Sales Advisor(s) cleaning and sanitizing dishware and cookware were exposed to hazardous chemicals including but not limited to KAY-5 Chlorinating Sanitizer (contains Sodium dichloro-s-triazinetrione) and KAY Pot & Pan Detergent (contains Anionic Surfactants). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
