29 CFR 1926.95(a):     Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) Worksite - 88 Poplar Street, Employees installing shingles on a roof with protruding nails, did not wear safety shoes; on or about 01/18/2012    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    a) Workplace - Employees installing shingles on a roof approximately 13 feet above the ground did not use any fall protection; on or about 01/18/12     Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a)Worksite - 88 poplar street, Garden City - Employees installing shingles on a residential roof approximately 13 feet above the ground did not have fall protection. Employees did not reconize the hazard of falls and ways to minimize the hazard, the employees were not trained; on or about 01/18/2012    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
