29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from from falling or flying objects.    a)     Worksite, 1137 Old Country Rd., Westbury, NY. - Employees were not wearing protective helmets and were exposed to being struck from overhead and the side by the backhoe they were working beside which was removing soil and asphalt from the work area; on or about 01/18/12.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a) Worksite- 1137 Old Country Rd., Westbury, NY.- Employees were observed working in a trench measured by CSHO to be 4'10" deep and 50' in length. There was no ladder or other means of egress in the trench; on or about 01/18/12.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

Employees were wearing hooded sweatshirts which were not marked or made of reflectorized or highly visible material; or about 01/28/12.
