29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: On or about January 18, 2012, and at times prior thereto, employees were exposed to a fall of approximately 13 feet to the ground below while accessing/exiting a roof without the ladder side rails extending at least 3 feet (.9 m) above the upper landing surface.
