29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. A. Kelstin, Inc. worksite located near the intersection of W. Monroe St. & Winnebago Ave., Sandusky, Ohio: On or about January 23, 2012, the employer did not ensure employees wore adequate eye protection while operating a rotary saw making cuts in the existing roadway while preparing for excavation work. The employee was wearing prescription glasses without side shields when operating the saw exposing the employee to the hazard of flying particles.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: A. Kelstin, Inc. worksite located near the intersection of W. Monroe St. & Winnebago Ave., Sandusky, Ohio: On or about January 23, 2012, the employer did not ensure employees were protected from cave-in/collapse hazards while working in an excavation approximately 8.10 feet deep consisting of "B" and "C" soil with near vertical walls. The employees entered the excavation to cover a lateral and to located the existing sanitary sewer main. Kelstin, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652, which was contained in OSHA inspection number 311608640, citation number 1, item number 2 and was affirmed as a final order on May 27, 2009, with respect to a workplace located at Marblehead, OH.
