29 CFR 1910.147(f)(3)(i): When servicing and/or maintenance is performed by a crew, craft, department or other group, they did not utilize a procedure which affords the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device. (a) PBF Energy Company, LLC, dba Toledo Refining Company, 1819 Woodville Road, Oregon, Ohio: On or about December 13, 2011, the employer did not ensure that employee work crews used a lockout procedure that provided a level of protection equivalent to a personal lockout. Employees used a lockout procedure when working on a pump in plant 8 that permitted multiple employees to work under the protection of one personal lock which exposed them to the hazards associated with the unexpected release of hazardous energy.

29 CFR 1910.147(f)(3)(ii)(D): Each authorized employee did not affix a personal lockout or tagout device to the group lockout device, group lockbox, or comparable mechanism when he or she began work: (a) PBF Energy Company, LLC, dba Toledo Refining Company, 1819 Woodville Road, Oregon, Ohio: On or about December 13, 2011, the employer did not ensure that employees working on a pump in plant 8 were protected from the unexpected release of hazardous energy through the use of personal locks or its equivalent. Multiple employees worked under the protection of one personal lock.

29 CFR 1910.147(f)(4): Specific procedures were not utilized during shift or personnel changes to ensure the continuity of lockout or tagout protection, including provisions for the orderly transfer of lockout or tagout device protection between off-going and on-coming employees, to minimize exposure to hazards from the unexpected energization or start-up of the machine or equipment or the release of stored energy. (a) PBF Energy Company, LLC, dba Toledo Refining Company, 1819 Woodville Road, Oregon, Ohio: On or about December 13, 2011, the employer did not ensure that employees used procedures that provided continuity of equipment lockout during shift or work crew changes. The keys to the lockout locks were maintained in a group lockbox with uncontrolled access and each on-coming employee did not verify that the equipment had been effectively de-energized and isolated before starting work. Employees were exposed to the hazards associated with the uncontrolled release of hazardous energy while working on a pump in plant 8.
