29 CFR 1926.652(a) (1): Each employee in an excavation was not protected from cave-ins by an adequate protective system; (a) Apex Plumbing, 5834 E. Montview Blvd., Denver, CO 80220: On and before January 25, 2012 the exposing and controlling employer did not ensure that two Apex employees performing work in a trench at depths greater than 5 feet were protected from cave ins and other dangers by an adequate protective system. Condition exposed employees to cave in and other hazards associated with trenches and excavations. The employer has been previously cited twice for a violation of this Occupational Safety and Health Standard or its equivalent standard, 29 CFR 1926.652(a)(1), the most recent taking place on December 10, 2009, stemming from inspection #313715278, Citation 2, Item 2, by the OSHA Englewood Area Office with a Final Order date of January 3, 2011, and previously inspection # 311905376, citation 2, item 1 B, with a final order date of August 3, 2009.

29 CFR 1926.651(j) (2): Employees where not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary; (a) Apex Plumbing, 5834 E. Montview Blvd., Denver, CO 80220: On and before January 25, 2012 the exposing and controlling employer did not ensure that two Apex employees performing work in a trench at depths greater than 5 feet were protected from excavated materials, specifically dirt, by keeping the pile at least two feet from the edge of the excavation. The employer has been previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard, 29 CFR 1926.652(j)(2). The most recent stemming from inspection # 311905376, citation 1, item 2, with a final order date of August 3, 2009.
