29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a)  T and J Company Inc. dba The Pruner-Tree Service @ 2013 Hunter Court, Fort Collins, CO 80522: On and before December 13th, 2011, the employer did not ensure that protective equipment was used in the following instances:    (1)  Employees were not wearing safety glasses when using chain saws, or working around chain saws;    (2)  Two employees were not wearing hearing protection when using chain saws;    (3)  Employees were not wearing hard hats; including one employee working on the ground under an employee using a chain saw in a tree;    (4)  One employee was not provided with cut resistant leg protection when expected to use chain saws to cut branches on the ground;    Conditions exposed employees to the hazards of projectiles to the eyes, to hearing loss, cuts and amputations, and struck by hazards from falling debris.                                                                              OR IN THE ALTERNATIVE    Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following serious hazards:    (a)  T and J Company Inc. dba The Pruner-Tree Service @ 2013 Hunter Court, Fort Collins, CO 80522:  On or before December 14th, 2011, the employer did not ensure that protective equipment was used in the following instances:    (1)  Employees were not wearing safety glasses when using chain saws or working around chain saws;    (2)  Employees were not wearing hearing protection when using chain saws;    (3)  Employees were not wearing hard hats, including one employee working on the ground under an employee using a chain saw in the tree;    (4)  One employee was not provided with cut resistant leg protection when expected to use, chain saws to cut branches on the ground;    Conditions exposed employees to the hazards of projectiles to the eyes, to hearing loss; cuts and amputations, and struck by hazards from falling debris and from moving vehicles.    Abatement Note:  Among other methods, American National Standards Institute (ANSI) Z133.1 - 2000 Section 4.2 provides that one feasible and acceptable abatement method includes providing personal protective equipment and requiring its use.
