29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) On or about January 23, 2012, BBL Builders L.P., as a controlling employer, did not ensure that DJK Siding (subcontractor) protected their employees from fall hazards of over 10 feet while they worked on an elevated platform (pump jack scaffold) without adequate guardrails or another fall protection system.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure: a) On or about January 23, 2012, BBL Builders L.P., as a controlling employer, did not ensure that Hull Associates LLC (subcontractor), DJK Siding (subcontractor) and Bibiano Lopez (subcontractor) protected their employees from falls of greater than 6 feet while they performed siding, framing and roofing work without adequate fall protection measures in place.
