29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. At the facility the employer is failing to ensure that the fork lift was taken out of service when the brake system was leaking brake fluid. The break fluid reservoir was empty at the time of the inspection on Hyster fork lift serial number 0208993P.
