The employer shall establish a program consisting of energy controlprocedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine orequipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall beisolated from the energy source and rendered inoperative.    The employer failed to develop and implement a written lockout and tag out program.  This was most recently evident during the inspection of the facility located at 100 W. Beaver Street, St. Edward, NE 68660, where the employer has employees performing maintenance on equipment that require lockout and tag out in order to safely work on it without having had developed a written program that outlines the principles, procedures and methods of safely performing lockout and/or tag out.

The employer failed to protect employees from potential struck by hazards associated with operating a forklift that has a hole in the forks.  This was most recently evident during the inspection of the facility located at 100 W. Beaver Street, St. Edward, NE 68660, where the employer has employees using the Komatsu Model FG 25-11 with a hole drilled into the fork to move trailers and materials throughout the facility.

Defects when found shall be immediately reported and corrected. Safety guards of the types described in Subparagraphs (3) and (4) of thisparagraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to theconstantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs(b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of theperipheral member at the top shall never exceed one-fourth inch. The employer failed to protect employees from potential struck by hazards associated with operating a bench grinder with the tongue guard adjusted greater than ?.  This was most recently evident during the inspection of the facility located at 100 W. Beaver Street, St. Edward, NE 68660, where the employer has employees using an unidentifiable bench grinder where the tongue guard is adjusted greater than ? to sharpen tools and grind sharp edges of metal in fabrication.

The employer failed to protect employees from potential electrical hazards associated with operating a chop saw where the power cord has strain placed on it to the point that it has been pulled more than half way out of the outlet.  This was most recently evident during the inspection of the facility located at 100 W. Beaver Street, St. Edward, NE 68660, where the employer has employees using an unidentifiable chop saw where the power cord hangs from the outlet without any form of strain relief thus causing the insulation on the cord near the plug to come apart exposing interior wiring as well as the cord plug to be pulled more than half way out of the outlet increasing the potential for an employee to be shocked when they use the equipment or attempt to unplug it.
