29 CFR 1910.178(l)(5):     If an operator has previously received training in a topic specified in paragraph (l)(3) of this section, and such training is appropriate to the truck and working conditions encountered, additional training in that topic is not required if the operator has been evaluated and found competent to operate the truck safely:    Employees who operated lull forklifts for J.J. Braker and Sons, Inc., had been trained by other employers prior to working at the facility were exposed to struck by injuries because the forklift operators had not been evaluated and found competent to operate the truck safely.

29 CFR 1910.178(m)(5)(ii):     A powered industrial truck is unattended when the operator is 25 ft. or more away from the vehicle which remains in his view, or whenever the operator leaves the vehicle and it is not in his view.    An employee was operating a JLG lull forklift to move some material and did not ensure the forklift was turned off when the operator dismounted the forklift and was no longer in the operators view.

29 CFR 1910.178(l)(4)(iii):     An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years:    An employee was operating a JLG lull forklift to move some material and the employer did not provide the required evaluation of performance through practical exercises for each operator at least once every three years.

29 CFR 1910.178(l)(6):     The employer did not certify that each operator has been trained and evaluated as required by paragraph (l) and shall include the name of the operator, the date of training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:    An employee was operating a JLG lull forklift to lower some material and the employer did not provide evidence to show that the required powered industrial training and evaluation had been conducted for the operator. There was no written documentation that included the operators name, date of the training, date of the evaluation and the name of the person conducting the training and/or evaluation.
