OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while working from an elevated position being supported by a forklift:    a. Site- Employees were not protected from falls while securing loads of building materials to delivery trucks when they were being elevated to the top of the load from a work platform supported by a forklift where no guardrails were provided on the work platform or personal fall arrest equipment was not provided by the employer. Additionally the work platform from which the employees worked from consisted of palletized building materials including, but not limited to, gypsum board which was not secured to the forklift.    b. Warehouse- An employee was not adequately protected from falls while replacing light bulbs in the ceiling light fixtures when they were being elevated to the ceiling from a work platform supported by a forklift where no guardrails were provided on the work platform and inadequate personal fall arrest equipment that allowed the employee to free fall greater than five feet was provided by the employer. Additionally the work platform from which the employee worked from consisted of palletized building materials including, but not limited to, gypsum board which was not secured to the forklift.
