29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system.    a)  Daniel Yoder on or about January 31, 2012, at the address of 1053 E. Center St. Marion, OH: The employer failed to ensure employees were protected from a fall while working from a ladder jack scaffold.  Employees were exposed to a near 16ft fall to the ground below during roofing operations of a residential structure. No form of fall protection was in place.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a)  Daniel Yoder on or about January 31, 2012, at the address of 1053 E. Center St. Marion, OH: The employer did not ensure employees were protected from falls while installing new roofing material to a residential type structure.  Employees were exposed to a 19 fall to the pavement below.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a) Daniel Yoder on or about January 31, 2012, at the address of 1053 E. Center St. Marion, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing various roofing operations.
