29 CFR 1926.651(k)(1):     An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:        Employees were working in an improperly sloped excavation and the competent person had not followed Appendix B, which specifies that the no benching is allowed for Type C soil.   The excavation  had a 5 foot high bench on the south side and a 4 foot high bench on the north side.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1):      In the excavation of Type C soil, which had been previously disturbed and water was accumulating into, the bench at the bottom of the slope's south side was 5 feet high, 4 feet on the north side.  The Appendix C specifies that the no benching is allowed for Type C soil.
