OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    The employer is failing to protect employees from potential fall hazards associated with employees using an unprotected work platform.  The most recent example of this was found on the job site located at 171 Road 3167, Hastings, NE 68902 where the employer has employees accessing the 300 swine bunkers twice a day while using an unprotected work platform.      Among other methods, feasible and acceptable methods of abatement are:    1.  The employer could install a guard rail system along the length of the bunker complexes.      2.  The employer could slope dirt along the length of the bunker complex in an effort to limit the fall exposure to less than 4.

The most recent example of this was found on the job site located at 171 Road 3167, Hastings, NE 68902 where the employer has employees accessing the 300 swine bunkers twice a day while using an unprotected work platform.    Among other methods, feasible and acceptable methods of abatement are:    1.  The employer shall install a guard rail system on the exposed edge of the stairs.      2.  The employer shall install a hand rail along the walled side of the stairs.

29 CFR 1910.1200(g)(8):     The employer shall maintain in the workplace copies of the required material safety data sheets foreach hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s).(Electronic access, microfiche, and other alternatives to maintaining paper copies of the material safety data sheets are permitted as long as nobarriers to immediate employee access in each workplace are created by such options.)    The employer failed to maintain material safety data sheets for the chemicals used within this facility.  This was most recently evident during the inspection of the facility located at 171 Road 3167, Hastings, NE 68902, where the employer has employees using Synergize as a cleaning and disinfecting agent while failing to provide a readily assessable MSDS.
