29 CFR 1910.147(c)(1): The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury:    On or about February 2, 2012, the employer had not established a lock-out/tag-out program for the facility for such machines as, but not limited to the laminating press and various saws on site as required.

29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about February 2, 2012, the employer had not conducted an evaluation of the powered industrial truck operators in the facility as required for such trucks as, but not limited to the Mitsubishi riding forklift.

29 CFR 1910.212(a)(1):  One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by rotating parts:    On or about February 2, 2012, the chop saw in use on the production floor used to cut metal extrusions and parts did not have a guard over the nut and flange holding the blade in place to prevent workers from coming into contact with the rotating part(s).

On or about February 2, 2012,  the winch used to move the stack of panels from the laminating machine had exposed improvised wiring present, to power the winch, at floor level where workers pass while the laminating operation is taking place.

29 CFR 1910.1200(h):  Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:    On or about February 2, 2012, the employer had not provided training for such hazardous materials/chemicals as, but not limited to the gypsum board, paints, general solvents and other applicable materials/chemicals used on the production floor.    Elements of a Hazard Communication information and training program are:    Information to employees shall include:    1)  Any operations in their work area where hazardous chemicals are present.    2)  The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets.    Training for employees shall include:    3)  Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.)    4)  The physical and health hazards of the chemicals in the work area,    5)  The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to  be used.    6)  The details of  the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information.
