29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. (a) The emergency brake on the Komatsu #2 (FG15) forklift was not functioning and it was not identified prior to the forklift being placed into service that shift. Employees were exposed to struck-by hazards.

29 CFR 1910.219(f)(3): Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more thanseven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided.This subparagraph does not apply to manually operated sprockets. (a) On the Large Bag Filling Line conveyor, a broken barrier guard exposed a moving chain and sprocket 25 inches off the floor. Employees were exposed to entanglement hazards.
