29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: Developing Department: On or about February 2, 2012, the employer did not implement an effective hearing conservation program in that they did not enforce the use of hearing protection, provide annual audiometric testing, and provided hearing protection training. Developer Department: The developer inspector was exposed to noise at 68.6% of the permissible daily exposure (8-hour time weighted average of 80 dBA) or the equivalent sound level of approximately 86.6 dBA during a 379 minutes sampling period on 02/02/12: exposure calculation includes a zero increment for the 101 minutes not sampled. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
