29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Two employees were observed performing masonry application to the chimney while standing on the 4:12 pitch roof of the residential structure without the use of any fall protection system. The eave to ground distance was approximately 11'11" at the west side of the structure and approximately 11' at the front of the residential structure located at 11607 Old St. Charles Road, Bridgeton, MO, 63044.
