29 CFR 1926.452(k)(5):     Scaffold platforms shall not be bridged one to another.    Employees were exposed to a fall hazard as they worked from the ladder jack scaffold erected at the west side of the structure.  The ladder jack scaffold had two work platforms bridged together above the combination ladder support.  The Warner 500 pound capacity platform was bridged on top of the Green Bull 500 pound capacity platform and secured with a nylon strap.  The ladder jack scaffold was utilized by employees as a working platform and to access the residential roof.  The porch to ladder jack platform height was approximately 9 feet.

29 CFR 1926.501(b)(13):     "Residential construction."  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems.  Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    Two employees were observed exposed to a fall hazard as they were actively performing residential roofing activities from an approximate 8:12 pitch roof at the job site located at 6214 Madison Avenue, Berkeley, MO, 63134.  The eave to porch distance was approximately 9 feet at the front, west facing side of the structure.  Employees were exposed to an approximate 15 foot fall hazard as they performed roofing activities along the northern, low slope portion of this residential roof.
