29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part (29 CFR 1926): a) On and before January 27, 2012, where construction-phased sequencing varied from prescribed structure erection design specified control methods the employer had not established safety and health programs which addressed construction activity inspection and a correction-coordination assurance program and procedures to ensure project-sequenced steel erection beam to column double connection point at end phases were in place at various locations of the casino and banquet deck levels with an adequate support system or devices to ensure (concrete slab form diaphragm) metal decking walking and working surfaces strength and structural integrity was being maintained prior to concrete being loaded onto it and to ensure adequate support devices or system installation for continued structural steel assembly erection from the end-phased double connection points. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) On and before January 27, 2012, the employer did not initiate and maintain a program for the frequent and regular inspection of the job site, materials and equipment at various locations of the casino and banquet deck levels to ensure that the (concrete slab form diaphragm) metal decking walking and working surfaces strength and structural integrity was being maintained and supported by various sequenced steel erection beam-to-column double connection point at end phases with an adequate number of bolts, welds, or other equivalent support systems / devices and with correction verification prior to concrete being loaded onto those surfaces as well as an inspection program to ensure adequate support device / system installation for continued structural steel assembly erection beyond the end-phased double connection points. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.754(a): Structural stability shall be maintained at all times during the erection process. On and before January 27, 2012, the contractor failed to ensure structural stability was being maintained on the casino and banquet deck levels at various sequenced construction steel erection beam-to-column double connection point-at-end phases. Due to an inadequate number of bolts, welds, or other equivalent support at those double connection points as a part of the structural steel assembly, a combination of loads on the structure during a concrete pour atop the metal decking exceeded the capability of the structure to resist, distribute and transfer the imposed loads and created an overload condition for the structural steel assembly at the end-phased double connection points supporting the structure which resulted in failure of the connection points and potential inadequate support for continued structursteel assembly erection from end phased double connection points exposing workers to crushing injuries and a fall potential of 25 feet..
