OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The back shop: On or about February 3, 2012 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles on a Worth, two post lift which the structural concrete show signs of fatigue and spall. b) The back shop: On or about February 3, 2012 and at times prior thereto, employees were exposed to a struck by hazard while elevating vehicles when the base plates on the Worth, two post lift were missing anchor bolts. c) The back shop: On or about February 3, 2012 and at times prior thereto, employees were exposed to a struck by hazard when elevating vehicles with damaged and missing rubber pads which contact the vehicle frame or lifting points. d) The back shop: On or about February 3, 2012 and at times prior thereto, employees were exposed to a struck by hazard when periodic inspections are not completed which would eliminate lift deficiencies.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding was not provided to protect the operatorand other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips andsparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. On or about February 3, 2012 and at times prior thereto, employees exposed to the unguarded rotating blade on the un-named tire sipe machine which is rotating at approximately 1725 rpm.
